Digital Millennium Copyright Act

Gunfight at the D.C. Corral; the guns win

In a narrow 5 to 4 result, the Court held that the District of Columbia's prohibition against handguns in the home violates the Second Amendment right of Americans to keep and bear arms. The full opinion by Justice Scalia is presented, along with the two dissenting opinions by Justices Stevens and Breyer. It is anticipated that this case will lead to the overturn and re-writing of numerous gun laws in the United States. Full opinion: D.C. v. Heller


DUI Convictions Ruled Not Violent Felonies

The U.S. Supreme Court held that DUI convictions are not "violent felonies," as that term is used in the Armed Career Criminal Act, 18 U.S.C. §924(e)(1). Justice Breyer wrote, "DUI differs from [other] crimes in at least one important respect: [Crimes] typically involve purposeful, violent, and aggressive conduct, whereas DUI statutes typically do not".
